MGB Property Management Rental Agreement 

                

This Agreement will commence on ____________between: Owner/Landlord: ______________Tenant: ____________________

1. Renter current address: _______________________The Owner agrees to rent to the Renter and the Renter agrees to rent from the Owner the following property: _______________________________

2. The term of this agreement will be a ___________lease agreement and will require the renter to give a 30 days advanced notice to the Owner/Landlord before vacating the property.

3. ______ a month rent will be due and payable on the 1st of each month and all payments should be paid by one of the following methods: (1) Employer payroll deduction (2) Electronic bank transfer (3) Electronic funds transfer (such as, Zelle, PayPal, Cash app) cash is not accepted.

4. The Renter agrees to pay a late fee of $75.00 for any payment received 5 days after the 1st of each month. If the rental payments are in default for over 7 days, or recurring late payments exceed 3 times within a 12 month period the Owner may immediately demand possession of the property without advance notice to the Renter.

5. The Owner warrants that the property is free of any known faults which would affect its safe operation under normal usage and is in good working condition.

6. The Renter states that the property has been inspected and is in good working condition. The Renter agrees to use the property in a safe manner and in normal usage and to maintain the property in good repair. The Renter further agrees not to use the property in a negligent manner or for any illegal purpose.

7. The Renter agrees to fully indemnify the Owner for any damage to or loss of the property during the term of this agreement, unless such loss or damage is caused by a defect of the rented property.

8. The Owner shall not be liable for any injury, loss, or damage caused by any use of the property.

9. The Renter has paid the Owner a security deposit of $______The Owner will hold this security deposit as security for payments for the repair of any damages to the property. This deposit will be returned to the Renter upon the termination of this agreement, minus any unpaid rent and/or repairs as noted to be made under the exit survey and/or beyond normal wear and tear.

10. The Renter may not assign or transfer any rights under this agreement to any other person, nor allow the property to be used by any other person, without the written consent of the Owner.

11. Renter agrees to obtain their own insurance coverage for their property during the term of this rental agreement. Renter agrees to not cancel their insurance policy during the term of this rental agreement.

12. Any dispute related to this agreement will be settled by voluntary mediation. If mediation is unsuccessful, the dispute will be settled by binding arbitration using an arbitrator of the American Arbitration Association.

13. The following are additional terms of this agreement: Completion and acceptance of the terms of the contract will require the Renter to complete:

a. Verification of Personal and Professional references, Employment check with proof of employment to include 2-3 current pay stubs or a signed/certified letter of employment from their current employer.

b. Move-In/Move-Out survey will require signatures of both parties. The security deposit will be held in escrow to cover any loss, damage or excessive wear to the unit. The Renter may elect to paint the unit during the term of this contract, No other materials or substances can cover the wall only paint otherwise the removal cost shall be deducted from the security deposit.

c. This agreement also stipulates that No Pets and No Smoking are allowed in the unit. In addition, No candles are allowed to be used in the unit as they may cause a fire. The renter will also agree to abide by all of the association bylaws and covenants; the landlord will furnish the renter with a copy of the bylaws.

d. The Renter will be furnished a storage unit _____in the lower level of the building and the Renter will have one carport parking space _____

e. Renter must pay for their own electric service and cable install & services. The water and heat are both included in the cost of the unit.

f. For any internal repairs please contact the Landlord by cell or text message___________________________________Any external repairs are handled by the Condominium Association. A work-order request form must be submitted for repairs by the landlord. For normal scheduled repairs the renter will be required to schedule access to the unit with the Landlord within 24-48 hours. Water pipe repairs or water leaks must be reported to the Landlord immediately to prevent damage to _____ and other units in the building. Prior to signing a contract renewal with the renter, the Landlord reserve the rights to inspect the condition of the unit for any damages.

15. This agreement is governed by the laws of the State of Michigan
